Jammu and Kashmir Peoples Conference President and Handwara MLA, Sajad Lone, has taken a bold step in addressing systemic injustices by filing a Public Interest Litigation (PIL) in the High Court of Jammu & Kashmir and Ladakh. The PIL, submitted through Advocate Syed Sajad Geelani, challenges the alleged misuse of police verification processes as a form of collective punishment, targeting individuals for their relatives' actions or affiliations.
Lone contends that the current verification process unjustly denies citizens basic rights such as employment, passports, and opportunities, violating constitutional guarantees of equality, dignity, and professional freedom. “The system must focus on an individual’s conduct, not factors beyond their control,” he said, emphasizing the need for transparency and fairness.
The petition calls for strict enforcement of existing guidelines, including the Jammu & Kashmir Civil Services Instructions, 1997, and subsequent amendments. It highlights instances of economic and emotional hardship caused by arbitrary practices, urging the judiciary to protect citizens from what Lone termed “ethically and constitutionally unjustified” processes.
This legal battle, Lone clarified, is not politically motivated but a commitment to justice and the protection of constitutional rights. The PIL, now under procedural review, could set a transformative precedent for governance and civil rights in the region.
