Srinagar– In a crucial legal battle concerning citizenship and cross-border travel, the High Court of Jammu & Kashmir and Ladakh has stayed the deportation of Mohammad Rustum Mir, providing him temporary relief.
The case, listed under WP(C) 2946/2024, was heard by Hon’ble Justice MA Chowdhary. Advocate Saleem Gul appeared for the petitioner, arguing for time to submit proof that Mir had traveled to Pakistan as an Indian citizen in 1986. On the other hand, Government Advocate Furqan Sofi, representing the Union Territory of Jammu & Kashmir, sought an adjournment to file objections against the petition.
The legal dispute stems from an official communication from the SSP, P.D. Handwara, which states that Mir traveled to Pakistan on valid documents in 1986 via Wagah. Additionally, his brother-in-law, Ab. Gaffar Shah, is reported to have moved to Pakistan in 1965 and is currently residing in Rawalpindi.
The court has scheduled the next hearing on February 25, 2025, directing that Mir shall not be deported until further orders. This case has drawn significant attention, raising critical questions about citizenship verification, cross-border travel, and individual rights under Indian law.
With Advocate Saleem Gul defending Mir’s right to remain in India and Government Advocate Furqan Sofi pushing for legal scrutiny, the next hearing will be crucial in determining the petitioner’s fate.
