No Kejriwal’s, now LG is ‘Government’ in Delhi as Centre notifies new law

The lieutenant governor of Delhi Anil Baijal has become the effective in-charge of the national capital as the Centre has notified a new law under which the city’s elected government will now have to seek the opinion of the L-G before taking any executive decision.

The provisions of the Act came into effect from April 27, according to the notification issued by the Ministry of Home Affairs (MHA).


Three key subjects in Delhi — public order, police and land — are already in the hands of the Central government while sectors such as health, education, agriculture, forest and transport are with the city government. The MHA notification seals the primacy given to the L-G, a nominee of the Central government, in the Act.

The Delhi government will now have to take permission from the L-G before taking any action over subjects which were under its domain. According to the legislation, the “government” in Delhi now means the “Lieutenant Governor”.

“In exercise of the powers conferred by sub-section (2) of section 1 of the Government of National Capital Territory of Delhi (Amendment) Act 2021 (15 of 2021), the Central Government hereby appoints the 27th April 2021 as the date on which the provisions of the said Act shall come into force,” stated the notification signed by additional secretary in the MHA, Govind Mohan.

The act has been notified at a time the Centre and the Arvind Kejriwal-led Delhi government are under the spotlight over the handling the pandemic and the subsequent scarcity of oxygen, hospital beds and essential medicines.

On Tuesday, the Delhi High Court came down heavily on the AAP government over its “failure” to check black marketing of oxygen cylinders and crucial medicines needed by COVID-19 patients. If the state cannot handle the situation, it will ask the Central government to take over gas re-filler units as it can’t let people die, the court said. When the bill was passed by Parliament last month – in the Lok Sabha on March 22 and in the Rajya Sabha on March 24 — Delhi Chief Minister Arvind Kejriwal had termed it a “sad day for Indian democracy”.

“The said bill will promote harmonious relations between the legislature and the executive, and further define the responsibilities of the elected government and the L-G, in line with the constitutional scheme of governance of the National Capital Territory of Delhi, as interpreted by the Supreme Court,” the statement of objects and reasons of the bill stated. “When a bill has been passed by the legislative assembly, it shall be presented to the lieutenant governor and the lieutenant governor shall declare either that he assents to the bill or that he withholds assent therefrom or that he reserves the bill for the consideration of the President…,” the bill said. The Centre maintained it is in line with the Supreme Court”s July 2018 ruling on the ambit of powers of the lieutenant governor and the Delhi government after a series of run-ins between the two

25 Covid Patients Dead At Delhi Hospital Due To Low Oxygen Pressure.

Delhi coronavirus: Several hospitals have, over the past three days, flagged a crisis of oxygen supply, beds and medicines amid rising Covid cases.

Twenty-five people died last night at the Jaipur Golden Hospital in Delhi due to shortage of medical oxygen, a top official at the hospital said today, highlighting the worsening situation in the national capital's hospitals.

"We had been allotted 3.5 metric tons of oxygen from the government. The supply was to reach us by 5 in the evening, but it reached around midnight. By then, 25 patients had died," Dr. DK Baluja, Medical Director at Jaipur Golden Hospital, told NDTV.

At least 215 Covid patients admitted at the hospital are critical and in dire need of oxygen, he added.

The hospital has now approached the Delhi High Court for help. "There is big human tragedy coming in next few minutes in our hospital. We have already lost 25 lives. We are gasping for oxygen. We have our Doctors before you. Please save lives. Please," Jaipur Golden Hospital said in its plea.

Jaipur Golden Hospital is the second hospital in the city to sent SOS over shortage of oxygen this morning.

The court has asked the Centre to strictly follow its order to provide medical oxygen to Delhi and ensure safe passage to oxygen without obstructions. "Beg, borrow or steal," said the judges, warning the centre that "all hell would break loose" if hospitals ran out of oxygen.

Last evening, Delhi logged 348 deaths linked to Covid, highest in a day so far. The city - battling with fourth Covid wave - also reported 24,331 new coronavirus cases.

Night curfew has been imposed in Delhi from 10 pm to 5 am with immediate effect till 30 April in the wake of the COVID situation, the Delhi government said on Tuesday, 6 April.

The number of COVID-19 cases in the national capital has been rapidly rising over the last couple of days. On Monday, the national capital reported 3,548 new cases and 15 deaths.

What’s allowed during night curfew? What’s not. Here’s all you need to know.
*Officials and officers of the Government of India.
*All private medical personnel such as doctors, nursing staff, paramedical staff, etc and other health services (such as hospitals, diagnostic centres, clinics, pharmacies, pharmaceutical companies and other medical & health service).
*Pregnant women and patients requiring medical / health services.
*Officers/officials· related to functioning of the offices of diplomats of various countries as well as persons holding any constitutional post on production of valid ID-card.
*Journalists for print and electronic media will be allowed to move on an e-pass as well.
*People coming from/going to airports/railway stations/lSBTs are allowed to travel on production of valid tickets.

What other services are allowed during the night curfew?

*Shops, dealing with foods, groceries, fruits & vegetables, dairy & milk booths, meat and fish, animal fodder, pharmaceuticals, medicines and medical equipment.
Banks, insurance offices and ATMs.
Telecommunications, Internet services, broadcasting and cable services, IT and IT-enabled services.
*Delivery of all essential goods, including food, pharmaceuticals, medical equipment through e-commerce.
Petrol pumps, LPG, CNG, petroleum and gas retail and storage outlets.
Power generation, transmission and distribution units and services.
Cold storage and warehousing services.
Private security services.
* Manufacturing units of essential commodities.
* Production units or services, which require continuous process.
